Affiliate Program Terms

Thank you for partnering with Forty-Six Ten Apparel Co. (“Forty-Six Ten,” “we,” “us”). These Affiliate Program Terms and Conditions (the “Terms”) govern your participation in our affiliate and ambassador program. By joining the program, generating an affiliate link or code, or promoting Forty-Six Ten in any way, you agree to these Terms. If you do not agree, do not participate in the program.

1. How commissions are earned

Affiliates earn a commission of 15% on qualifying sales that they personally and genuinely originate. A sale qualifies only when a real customer, acting on their own, clicks your affiliate link and completes a purchase within the attribution window. The current attribution (cookie) window is 7 days from the click.

Commissions are earned on incremental sales only: sales you brought to Forty-Six Ten that we would not otherwise have received. Commissions are not earned on customers that Forty-Six Ten originated through its own marketing, including our organic search presence, our email and SMS, our own paid advertising, direct traffic, or returning customers.

2. Prohibited promotion methods

The following are strictly prohibited. Any referral generated in whole or in part through these methods is invalid and will not be paid, regardless of how our third-party tracking software attributes it:

  • Paid search advertising. Running pay-per-click or paid search ads (including Google Ads, Bing Ads, or any search or shopping network) to promote Forty-Six Ten is not permitted without our prior written approval.
  • Brand and product-name bidding. Bidding on, or purchasing ads targeting, the terms “Forty-Six Ten,” “Forty Six Ten,” “4610,” “fortysixten,” any of our product names, taglines, or slogans, or any misspellings, variations, or combinations of them, on any platform, is prohibited.
  • Trademark-plus and brand-adjacent keywords. Bidding on keywords that combine or closely track our brand, product line, or campaigns in order to intercept demand we created is prohibited.
  • Using our website or brand in ads. Displaying fortysixten.net, our logo, or our brand as the visible or destination URL in any paid advertisement is prohibited.
  • Cookie stuffing and forced attribution. Any method that sets the affiliate cookie without a genuine, intentional click by the customer is prohibited. This includes forced clicks, automatic redirects, iframes, hidden pixels, pop-ups, pop-unders, browser extensions, and toolbars.
  • Non-genuine or purchased traffic. Bot traffic, incentivized clicks, click farms, self-referrals, and traffic you did not earn through your own honest promotion are prohibited.
  • Misrepresentation and spam. Unsolicited email or SMS, false or misleading claims about our products or offers, unauthorized coupon or deal listings, and impersonating Forty-Six Ten are prohibited.

3. Attribution and how we verify referrals

Our affiliate tracking software records the last affiliate link a customer clicked. A recorded click is not, by itself, proof that an affiliate caused a sale. To determine the true source of a customer, Forty-Six Ten may rely on any data available to us, including our Shopify order and customer-journey analytics, which show how a customer actually found and reached us.

Where our records show that a customer was originated by Forty-Six Ten's own marketing, or that a referral was generated through any prohibited method in Section 2, the referral is invalid and no commission is owed, even if the tracking software attributed the order to an affiliate.

4. Review, holding, denial, and reversal of commissions

Forty-Six Ten may review any referral or commission at any time, before or after approval or payout. We may hold, deny, or reverse a commission, and remove or reject a referral, if we determine in our reasonable judgment that it does not meet these Terms. Determinations of validity are made at our discretion based on the information available to us.

5. Suspension and termination

We may suspend or terminate any affiliate, and disable any affiliate link or code, at any time and for any reason, including violation of these Terms. On termination for a violation, any pending or unpaid commissions are forfeited and previously attributed referrals may be reversed.

6. Independent relationship

Affiliates are independent participants, not employees, agents, or representatives of Forty-Six Ten, and have no authority to act or make commitments on our behalf. Affiliates are responsible for their own taxes and for complying with all applicable laws, advertising rules, and platform policies, including disclosing their affiliate relationship where required.

7. Changes to these Terms

We may update these Terms at any time. The current version is the one posted here. Continued participation in the program after an update means you accept the updated Terms.
